A settlement has been approved by a court of law to resolve a lawsuit brought on behalf of individuals employed by Mavis Tire Supply LLC (“Mavis”) as non-exempt, hourly-paid Assistant Managers (referred to in this Notice as “AMs”) in New York between January 5, 2017 and January 5, 2023 in New York or New Jersey, and between January 5, 2020 and January 5, 2023 in other states (the “Collective Periods”).

Mavis denies the allegations in the lawsuit and maintains that AMs were properly and fully compensated for all hours worked in accordance with the law at all times, and that additional overtime wages are not owed.

Deadline to Join: September 19, 2023
YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT:
TIMELY RETURN THE ENCLOSED CONSENT TO JOIN/CLAIM FORM AND RELEASE BY CLICKING THE “CLAIM FORM” TAB ABOVE. Receive a settlement payment. Give up wage and hour claims for the period indicated below.

By completing a Consent to Join/Claim Form and Release and mailing, e-mailing, faxing, or submitting it online to the proper address so that it is postmarked, sent, or submitted by September 19, 2023, you agree to participate in the settlement, receive a monetary settlement payment, release your claims, and to be bound by the Judgment entered by the Court. You will also give up the right to sue Mavis (as defined in the Agreement) for any and all wage and hour claims under the FLSA or any other state wage and hour law relating to your employment as a Mavis AM up to January 5, 2023, including but not limited to related claims for penalties, interest, liquidated damages, equitable remedies, pre- or post-judgment interest, and attorneys’ fees, costs, and expenses. You will also be enjoined from pursuing any of these claims against Mavis (as defined in the Agreement) if you agree to participate in this settlement.
DO NOTHING. If you do not wish to participate in, or be bound by, the settlement, you should not return the Claim Form. If you do not timely return a properly completed Claim Form, then you will not give up any rights, and you will not receive any monetary payment under the settlement.
