What does the settlement provide?
Mavis has agreed to pay up to $4,200,000.00 into a fund to pay settlement payments to those individuals who timely submit a fully completed and signed Claim Form (“Authorized Claimants”), Court-approved attorneys’ fees, costs, and expenses of $1,410,000.00, Settlement Administration Costs, Court-approved General Release Payments in the Settlement totaling $50,000.00 to the Named Plaintiffs who originally retained Named Plaintiffs’ Counsel to pursue these claims on behalf of all AMs, and payroll and other applicable taxes, including, the employer’s share of payroll taxes.

After deducting the Court-approved attorneys’ fees, costs, and expenses, Settlement Administration Costs, Court-approved General Release Payments, and payroll and other applicable taxes (including the employer’s share of payroll taxes), the remaining amount will be allocated among the AMs in the Settlement Collective, based on the number of weeks they worked as AMs during the Collective Periods.

If you participate in the Settlement, then you will receive an estimated settlement payment, which is based on the number of weeks you worked as a non-exempt, hourly-paid AM for Mavis, according to Mavis’ records. Under the terms of the settlement, half of your payment will be treated as wages and will be subject to deductions for payroll taxes and other legally required withholdings and you will receive an IRS Form W-2 for that amount. The other half of your payment will be treated as non-wage income and you will receive an IRS Form 1099 for that amount. Settlement checks that are not cashed within 120 days of issuance will be null and void .
How do I receive a settlement payment?
You must fully complete, sign, and timely return a Claim Form to the Claims Administrator by U.S. Mail, e-mail, facsimile, or web submission at the address below so that it is postmarked or received by September 12, 2023. The Claims Administrator’s contact information is:

If you timely return a fully completed and signed Claim Form to the Claims Administrator by the deadline, then you will be sent directly a settlement check at the address on the Claim Form you submitted after all appeals have been exhausted. If your address changes, then please call 877-883-9956. It is your responsibility to keep an updated address on file with the Claims Administrator.
What am I giving up in exchange for a settlement payment?
You will not become a member of the collective action and participate in the settlement unless you timely return a fully completed and signed Claim Form by the deadline. Once you submit a Claim Form and become an Authorized Claimant, you cannot sue, continue to sue, or be a party to any other lawsuit against Mavis or any of the Released Parties (as defined in the Agreement) for wage and hour claims under the FLSA or any other state wage and hour law relating to your employment as a Mavis AM up through January 5, 2023, including but not limited to all related claims for penalties, interest, equitable remedies, liquidated damages, pre- or post-judgment interest, and attorneys’ fees, costs, and expenses, and you will be enjoined from pursuing such claims in the future. In sum, you will be forever barred (individually, as a representative member of any class, and through any collective proceedings) from filing any civil action, lawsuit, grievance, demand for arbitration, charge, claim, and/or administrative complaint against Mavis or any of the Released Parties, arising out of, or related to, any such claims.
